Application of the General Terms and Conditions of Sale

These terms and conditions apply to the sale of products by SAS Moulin de Gassac through its shop accessible via the Internet, postal mail, and telephone. They are automatically made available to the buyer on the homepage of the Daumas-Gassac website. The buyer only needs to click on "General Terms and Conditions of Sale" (here in after referred to as GTC) to know the conditions of their order, even before starting the ordering process.

Consequently, placing an order implies full and unreserved acceptance by the buyer of these GTC, to the exclusion of all other documents such as brochures or catalogues issued by the seller, which have only indicative value. The fact that the seller does not take advantage at a given time of any of the provisions of these GTC cannot be interpreted as a waiver of the right to invoke them later. Our offers are exclusively reserved for individual customers, excluding professional resellers.

Prices

SAS Moulin de Gassac is committed to the prices announced on the site within the limits of available stocks. Prices are quoted in Euros (€). They are inclusive of all taxes (TTC), excluding shipping costs, except for sales without commitment.

Products delivered in mainland France and Corsica: prices include VAT and French duties. For orders delivered within the European Community, prices include VAT and French duties but do not include excise duties or other taxes in effect in certain European countries that may be claimed from the buyer upon delivery.

1. Types de transport

We use different carriers:

1. Chronopost: delivery of 1 to 24 bottles in mainland France and certain European and international countries (see list* – excluding Great Britain & Ireland).
2. Schenker: delivery of 27 bottles or more in mainland France.
3. Calberson: delivery of 27 bottles or more in certain European and international countries (see list*) – excluding mainland France and Great Britain & Ireland.
4. Delivery to Great Britain** and Ireland: different carrier, please contact us at contact@daumas-gassac.com.

We can also deliver to one of our carrier’s depots. Here is the list of depots:

3. 2024 carrier costs (TTC) for En Primeur Allocation

2 cases of 3 bottles = 1 case of 6 bottles = 1 case of 3 magnums = 1 wooden case of 1 Jeroboam - Wines will be shipped and/or available at the cellar in March/April 2025.

4. Delivery Terms and Times (excluding En Primeur)

1. Chronopost Carrier: Delivery in Mainland France within 24 to 48 hours - business days except for exceptional delays - after order processing and shipment. For deliveries (outside France), allow approximately 7 business days. Once the driver has arrived at the delivery address, if the delivery cannot be made, the packages may be left at the nearest collection point or post office (which has the capacity to store them).

2. Schenker Carrier: Delivery within 7 to 10 business days - except for exceptional delays - from order processing and shipment. Delivery during the day, no specific time slots available. No delivery to upper floors possible. The pallet and the film used to transport the wines will not be taken back by the carrier. The pallet is left just in front of the specified address. Once the order is shipped, Schenker will contact you by email to schedule a delivery day. The appointment must be scheduled within 7 business days from the shipment date. If the deadlines are exceeded, storage fees will be charged. In case of order modification after validation, additional fees may be charged. In case of cancellation: a refund of the order is possible; however, the shipping costs will be deducted.

3. Calberson Carrier: Delivery within 10 to 15 business days (depending on the country) - except for exceptional delays - from order processing and shipment. Delivery during the day, no specific time slots available. No delivery to upper floors possible. The pallet and the film used to transport the wines will not be taken back by the carrier. The pallet is left just in front of the specified address. Once the order is shipped, Calberson will contact you by email to schedule a delivery day. The appointment must be scheduled within 7 to 10 business days from the shipment date. If the deadlines are exceeded, storage fees will be charged. In case of order modification after validation, additional fees may be charged. In case of cancellation: a refund of the order is possible; however, the shipping costs will be deducted from this refund.

5. Delivery Terms and Times (En Primeur Allocation)

The same terms as in chapter 4 apply.

Delivery of the 2024 En Primeur Allocations will take place starting from March/April 2025.

NOTE: If you order En Primeur wines at the same time as wines outside the En Primeur Offer, delivery will be made in March/April 2025 with the En Primeur wines.

6. Collect at the domaine

• Non-En Primeur: Collect your order after payment within a maximum period of 3 months (we reserve the right to change the vintage of Moulin de Gassac wines between the time the order is placed and paid for and the time the order is collected) based on available stock at the time of collection. 
• 2024 En Primeur:  Collect your order at the winery until December 31, 2025. If these deadlines are not met, storage fees will apply.

7. Payment

a. Payment Terms

The price of the ordered items is payable in full to SAS Moulin de Gassac upon issuance of your order form.

The order of wines requires payment of the total amount including all taxes at the time of ordering. Upon receipt of your order accompanied by payment, we will send you a reservation certificate or a pro forma invoice.

Upon receipt of payment for the order:

• We issue an order form and ship (non-En Primeur) the order. In the event of non-payment, we reserve the right to cancel the order.
• For En Primeur: Upon receipt of the order accompanied by payment, we issue an order form and a reservation certificate. The order will be shipped in the spring of the following year. When the wines have been bottled the following year, we will notify you of the delivery by email, provided you have given us your latest contact details.

b. Payment Methods

1 – Internet: Secure payment by credit card.

Only credit cards bearing the CB, VISA, EUROCARD, MASTERCARD, AMERICAN EXPRESS, or APPLE PAY logos are accepted.

2 – Bank Transfer

On the "Delivery and Payment" page, choose the payment method by bank transfer.

c. Transport and Responsibility

The goods travel at your expense and risk. Therefore, it is your responsibility to check the contents of the package at the time of delivery and to make reservations on the delivery slip provided by the carrier.
In all cases, notify SAS Moulin de Gassac within three (3) days of receiving the package(s).
In the event of breakage or damage, noted by reservation, SAS Moulin de Gassac will take the necessary steps to deliver again, or otherwise refund the amount paid at the time of order. Your account will be credited, and Moulin de Gassac's account will be debited accordingly. You will be notified by our Customer Service.

Product Return

Votre droit:
In accordance with Article L. 121-16 of the Consumer Code, you have the option to return, at your expense, the product to the following address:

You must return the product within fourteen days (Hammon Law of June 13, 2014) from the date of delivery for an exchange or refund. The product must be in good condition and in its original packaging, along with the original invoice.

As a guideline, the return cost for a 30kg package is approximately €50.

For En Primeur wines, you have a period of fourteen working days from the receipt of your reservation certificate to request a modification or cancellation and refund of your order. After this period, the order will be considered final.

Return Shipping Costs:

SAS Moulin de Gassac will only cover return shipping costs under one of the following conditions:
The delivery is not in accordance with the order or you made reservations with the carrier..

1. PROTECTION OF MINORS

In accordance with Article L. 3342-1 of the Public Health Code, which stipulates that the sale of alcohol to minors under the age of 18 is prohibited, by filling out the order form, you agree to be at least eighteen years old on the date of the order.

2. DATA PROTECTION

Moulin de Gassac strictly adheres to Law 78-17 of January 6, 1978, regarding "data processing, files, and freedoms" as well as the ethical principles that result from it concerning the personal information you may provide us when placing an order on our website. This personal information is protected, declared to the CNIL, and exclusively reserved for the use of our production staff. You have the right to access, modify, rectify, and delete your personal data. 3. MODIFICATION, INTERRUPTION AND TERMINATION

Moulin de Gassac reserves the right, at its sole discretion, to add, delete, or modify at any time any part of the services included on the website, to temporarily interrupt, or to terminate this license. Legal notices may also be modified or adapted at any time. You are invited to consult them regularly and to comply with them without reservation.

4. LIMITATION OF LIABILITY

Moulin de Gassac has prepared the content of this site with care and technical expertise. It strives to ensure the accuracy and update of the information disseminated on the site to the best of its abilities and reserves the right to modify the content at any time. Therefore, the information and visuals disseminated are for informational purposes only and cannot constitute a contractual document that could justify legal action. Moulin de Gassac cannot be held responsible for any direct or indirect damage—regardless of its cause, origin, nature, and consequences—resulting from accessing the site, using it, or being unable to access it, as well as any damage to users' equipment.

5. INTELLECTUAL PROPERTY

The entire site, and each of its elements taken separately, constitute a protected work and are subject to French and international legislation on copyright and intellectual property. No commercial exploitation, reproduction, representation, use, adaptation, modification, incorporation, translation, or commercialization, partial or complete, of the elements of this site can be carried out without the prior authorization of Moulin de Gassac. Violation of this intellectual and/or industrial property right is an act of counterfeiting punishable by a sentence of 2 years in prison and a fine of 150,000 euros.
